EULA and Privacy Policy
Welcome to use AI Health Weather, please read this End User License Agreement carefully before clicking the Agree button, downloading or using 《App》.
Interpretation and Definitions
  • The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • 《App》means the software program provided by the AIcR✚ downloaded by You through an Application Store's account to a Device, named AI Health Weather.

  • 《EULA-PP》means this End-User License Agreement that forms the entire agreement between You and the AIcR✚ regarding the use of the《App》.

  • Account means a unique account created for You to access the《App》.

  • AIcR✚ means the company that develops and provided the software program, named AI Health Weather. For the purpose of the GDPR, the AIcR✚ is the Data Controller.

  • Application Store means the digital distribution service operated and developed by Apple App Store or Google Play Store by which the《App》has been downloaded to your Device.

  • Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the AIcR✚ as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

  • Device means any device that can access the《App》such as a mobile phone or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.
      • 👉 For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.
      👉 For the purposes of the CCPA (California Consumer Privacy Act), Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

  • Service refers to the AI Health Weather.

  • Service Provider means any natural or legal person who processes the data on behalf of the AIcR✚. It refers to third-party companies or individuals employed by the AIcR✚ to facilitate the Service, to provide the Service on behalf of the AIcR✚, to perform services related to the Service or to assist the AIcR✚ in analyzing how the Service is used.
    For the purpose of the GDPR, Service Providers are considered Data Processors.

  • Usage Data refers to data collected automatically, either generated by the use of the《App》or from the《App》infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the《App》or the company, or other legal entity on behalf of which such individual is accessing or using the《App》, as applicable.

  • Family Sharing / Family Group permits You to share《App》downloaded through the Application Store with other family members by allowing them to view and download each others' eligible《App》to their associated Devices.
Acknowledgment
■ By clicking the Agree button, downloading or using the《App》, You are agreeing to be bound by the terms and conditions of this《EULA-PP》. If You do not agree to the terms of this《EULA-PP》, do not click on the Agree button, do not download or do not use the《App》.

■ This《EULA-PP》is a legal document between You and the AIcR✚ and it governs your use of the《App》made available to You by the AIcR✚.

■ Since the《App》can be accessed and used by other users via, for example, Family Sharing / Family Group or volume purchasing, the use of the《App》by those users is expressly subject to this《EULA-PP》.

■ The《App》is licensed, not sold, to You by the AIcR✚ for use strictly in accordance with the terms of this《EULA-PP》.

Scope and Restrictions of License
  • The AIcR✚ grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the《App》strictly in accordance with the terms of this《EULA-PP》.

  • You may only use the《App》on a Device that You own or control and as permitted by the Application Store's terms and conditions.

  • The license that is granted to You by the AIcR✚ is solely for your personal, non-commercial purposes strictly in accordance with the terms of this《EULA-PP》.

  • You agree not to, and You will not permit others to:
      👉 License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the《App》or make the《App》available to any third party.
      👉 Decompile, disassemble or any other software reverse engineering to the《App》.
      👉 Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of the AIcR✚ or its affiliates, partners, suppliers or the licensors of the《App》.
Intellectual Property
  • The《App》, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of the AIcR✚.

  • The AIcR✚ shall not be obligated to indemnify or defend You with respect to any third party claim arising out of or relating to the《App》.
Installation/ Modifications/ Updates/ Maintenance to the《App》
  • The installation / updates of the《App》 must be from the 'Application Store' or the《App》itself, the other way will be have security issues, any problems or damages of your Device(HW and SW) or any legal problems are nothing to do with the AIcR✚.

  • The AIcR✚ reserves the right to modify, suspend or discontinue, temporarily or permanently, the《App》or any service to which it connects, with or without notice and without liability to You.

  • Updates may modify or delete certain features and/or functionalities of the《App》. You agree that the AIcR✚ has no obligation to provide any Updates, or continue to provide or enable any particular features and/or functionalities of the《App》to You.

  • You further agree that all updates or any other modifications will be 👉 deemed to constitute an integral part of the《App》, and 👉 subject to the terms and conditions of this《EULA-PP》.

  • The AIcR✚ does not provide any maintenance or support for the download and use of the《App》.
About Your Personal Data
【Types of Data Collected】
  • While using AIcR✚'s Service, AIcR✚ may ask You to provide AIcR✚ with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

      👉 Instant Message (IM) app account
      👉 Health Data
【Sources of Personal Information】
  • Directly from You. For example, from the forms You complete on AIcR✚'s Service, preferences You express or provide through AIcR✚'s Service, or from Your purchases on AIcR✚'s Service.

  • Indirectly from You. For example, from observing Your activity on AIcR✚'s Service.

  • Automatically from You. For example, through AIcR✚'s Service Providers set on Your Device as You navigate through AIcR✚'s Service.

  • From Service Providers. For example, third-party vendors to monitor and analyze the use of AIcR✚'s Service, third-party vendors for payment processing, or other third-party vendors that AIcR✚ use to provide the Service to You.

  • 【To manage Your requests】To attend and manage Your requests to AIcR✚.

  • 【For business transfers】AIcR✚ may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of AIcR✚'s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by AIcR✚ about our Service users is among the assets transferred.

  • 【For other purposes】AIcR✚ may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve AIcR✚'s Service, products, services, marketing and your experience.

  • 【With business partners】AIcR✚ may share Your information with AIcR✚'s business partners to offer You certain products, services or promotions.

  • 【For business transfers】AIcR✚ may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of AIcR✚ assets, financing, or acquisition of all or a portion of AIcR✚'s business to another company.

  • 【With other users】when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.

  • 【With Your consent】AIcR✚ may disclose Your personal information for any other purpose with Your consent.
【Retention of Your Personal Data】
  • The AIcR✚ will retain Your Personal Data only for as long as is necessary for the purposes set out in this《EULA-PP》. AIcR✚ will retain and use Your Personal Data to the extent necessary to comply with AIcR✚'s legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce AIcR✚'s legal agreements and policies.

  • The AIcR✚ will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of AIcR✚'s Service, or AIcR✚ is legally obligated to retain this data for longer time periods.
【Transfer of Your Personal Data】
  • Your information, including Personal Data, is processed at the AIcR✚'s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to …and maintained on… computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

  • Your consent to this《EULA-PP》followed by Your submission of such information represents Your agreement to that transfer.
【Disclosure of Your Personal Data】
  • If the AIcR✚ is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. AIcR✚ will provide notice before Your Personal Data is transferred and becomes subject to a different with this《EULA-PP》.

  • Under certain circumstances, the AIcR✚ may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

  • The AIcR✚ may disclose Your Personal Data in the good faith belief that such action is necessary to:
      • 👉 Comply with a legal obligation
      👉 Protect and defend the rights or property of the AIcR✚
      👉 Prevent or investigate possible wrongdoing in connection with the Service
      👉 Protect the personal safety of Users of the Service or the public
      👉 Protect against legal liability
【Security of Your Personal Data】
The security of Your Personal Data is important to AIcR✚, but there is no method of transmission over the Internet, or method of electronic storage is 100% secure. While AIcR✚ strive to use commercially acceptable means to protect Your Personal Data, AIcR✚ cannot guarantee its absolute security.
  • The《App》is a non real-name system, no one know who You are and who does this Personal Data belong to.

  • The《App》ONLY require your basic personal information, not sensitive data (e.g. real name, social security number, credit card number, bank account, home address…etc), there is no risk of these data being leaked.

  • Most of Your Personal Data are use the internal codes, no one know what these codes mean except the designer, Your Personal Data have a best security.

  • If there is any harmful software (e.g. viruses, trojan horses, worms, malware, timebombs, scripts…etc) in your Device, cause Your Personal Data to be compromised and thereby cause any kinds of damages/legal problems, You have responsibility for all of these and nothing to do with the AIcR✚.

  • The AIcR✚ may provide paid products and/or services within the Service. In that case, AIcR✚ may use third-party services for payment processing (e.g. Application Store). The AIcR✚ will not store or collect Your payment card details. That information is provided directly to The AIcR✚'s third-party payment processors whose use of Your personal information is governed by their Privacy Policy.
【Your Rights under the GDPR】
You have the right under this《EULA-PP》, and by law if You are within the EU, to:
  • Request access to Your Personal Data. The right to access, update or delete the information the AIcR✚ have on You. Whenever made possible, you can access, update or request deletion of Your Personal Data directly within Your account settings section. If you are unable to perform these actions by yourself, please contact AIcR✚ to assist You.

  • Request correction of the Personal Data that AIcR✚ hold about You. You have the right to have any incomplete or inaccurate information AIcR✚ hold about You corrected.

  • Object to processing of Your Personal Data. This right exists where the AIcR✚ are relying on a legitimate interest as the legal basis for AIcR✚'s processing and there is something about Your particular situation, which makes You want to object to AIcR✚'s processing of Your Personal Data on this ground. You also have the right to object where the AIcR✚ are processing Your Personal Data for direct marketing purposes.

  • Request erasure of Your Personal Data. You have the right to ask AIcR✚ to delete or remove Personal Data when there is no good reason for AIcR✚ to continue processing it.

  • Request the transfer of Your Personal Data. AIcR✚ will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which You initially provided consent for AIcR✚ to use or where AIcR✚ used the information to perform a contract with You.

  • Withdraw Your consent. You have the right to withdraw Your consent on using your Personal Data. If You withdraw Your consent, AIcR✚ may not be able to provide You with access to certain specific functionalities of the Service.
Term and Termination
  • This《EULA-PP》shall remain in effect until terminated by You or the AIcR✚.

  • The AIcR✚ may, in its sole discretion, at any time and for any or no reason, suspend or terminate this《EULA-PP》with or without prior notice.

  • This《EULA-PP》will terminate immediately, without prior notice from the AIcR✚, in the event that you fail to comply with any provision of this《EULA-PP》. You may also terminate this《EULA-PP》by deleting the《App》and all copies thereof from your Device or from your computer.

  • Upon termination of this《EULA-PP》, You shall cease all use of the《App》and delete all copies of the《App》from your Device.

  • Termination of this《EULA-PP》will not limit any of the AIcR✚'s rights or remedies at law or in equity in case of breach by You (during the term of this《EULA-PP》) of any of your obligations under the present《EULA-PP》.
Limitation of Liability
  • Notwithstanding any damages that You might incur, the entire liability of the AIcR✚ and any of its suppliers under any provision of this《EULA-PP》and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the《App》or through the《App》.

  • To the maximum extent permitted by applicable law, in no event shall the AIcR✚ or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the《App》, third-party software and/or third-party hardware used with the《App》, or otherwise in connection with any provision of this《EULA-PP》), even if the AIcR✚ or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

  • You expressly understand and agree that the Application Store, its subsidiaries and affiliates, and its licensors shall not be liable to You under any theory of liability for any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by You, including any loss of data, whether or not the Application Store or its representatives have been advised of or should have been aware of the possibility of any such losses arising.
Indemnification and No Warranties
  • You agree to indemnify and hold the AIcR✚ and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your:
    👉 use of the《App》
    👉 violation of this《EULA-PP》or any law or regulation
    👉 violation of any right of a third party

  • The《App》is provided to You AS IS and AS AVAILABLE and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the AIcR✚, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the《App》, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the AIcR✚ provides no warranty or undertaking, and makes no representation of any kind that the《App》will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

  • Without limiting the foregoing, neither the AIcR✚ nor any of the company's provider makes any representation or warranty of any kind, express or implied:
    👉 as to the operation or availability of the《App》, or the information, content, and materials or products included thereon
    👉 that the《App》will be uninterrupted or error-free
    👉 as to the accuracy, reliability, or currency of any information or content provided through the《App》
    👉 that the《App》, its servers, the content, or e-mails sent from or on behalf of the AIcR✚ are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

  • Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
Changes to this《EULA-PP》
and Governing Law
  • The AIcR✚ reserves the right, at its sole discretion, to modify or replace this《EULA-PP》at any time.

  • The newest《EULA-PP》in the latest version of the《App》, You can check out by click the right up┇menu of the《App》. By continuing to access or use the《App》after any revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, You are no longer authorized to use the《App》.

  • The laws of the Country, excluding its conflicts of law rules, shall govern this《EULA-PP》and your use of the《App》. Your use of the《App》may also be subject to other local, state, national, or international laws.
